APRIL 22, 2010 UPDATE

 

The decision of Circuit Judge Michael Jones has been appealed to the First District Court of Appeal (1st DCA) in Tallahassee.  The notice of appeal was filed on April 12th.  Additional paperwork will be filed with the 1st DCA by attorneys representing both sides.  A hearing date will be set in the months to come.

 

The Santa Rosa case known as “Accardo v. Brown” (Clerk’s file # 06-1064-CA) involves the taxation of leasehold land on Navarre Beach.  A hearing is scheduled for May 7th at 8:30 am before Judge Gary Bergosh in the court house in Milton.  A 4 hour time slot has been set aside for arguments in this case.  The hearing will be held in a court room to be assigned prior to the hearing.  Interested parties may attend.  Navarre Beach is being taxes on the land, as well as the improvements.  They are represented by Danny Kepner of Shell, Fleming Davis & Menge, who has filed our appeal on taxation of the improvements on Pensacola Beach.  The ruling on taxing leasehold land on Navarre Beach case will certainly have implications for Pensacola Beach.
