MARCH 21, 2005 UPDATE
A hearing has been scheduled for April 14 on the Plaintiffs’
Motion For a Stay and Declaratory Order. With so much paperwork filed in this case,
this will be the first hearing in front of a judge. We were forewarned that this is a slow
process. All the legal documents filed
with the court to date have been posted to the web site.
Communicating with over 3,400 named plaintiffs in this suit
is a big undertaking. A memorandum from
Shell, Fleming, Davis
and Menge was mailed to plaintiffs on February 8 summarizing the issues in the
case and providing some legal advice based on questions posed to our attorneys.
Due to an unfortunate oversight,
the memo was sent at the bulk mail rate.
We realize that not everyone received the memorandum. The big thing you missed if you did not get
the memo, was the chance to attend a meeting with our
attorneys on March 12. All the important
information from the first mailing will be repeated in a second mailing that
will go out as first class mail in the next couple of weeks. First class mail will be forwarded and should
reach out of town leaseholders in a reasonable amount of time.
