Requirements for New Plaintiffs in the 2009 Complaint

(If you were a plaintiff in 04, 05, 06 or 07, please read the October 31, 2008 update.)

 

Residential leaseholders who acquired leasehold interests in 2009 have the opportunity to join the lawsuit now that the tax rolls are certified.  It does not matter if the prior leaseholder was a party to the lawsuit or not.  Leaseholders who have acquired leasehold interest in a Pensacola Beach property in 2009 must provide necessary documents and contribute to the cost of the litigation no later than November 20, 2009 in order to be included in this legal action.

 

Residential single family and condominium leaseholders on Pensacola Beach, who were not named plaintiffs for a particular parcel in either the prior years lawsuits, can also be added to the complaint contesting 2009 real property taxes at this time.  NOTE: This will only cover you for the 2009 tax year and not the prior years.

 

To be a 2009 plaintiff, a person, persons or entity must be able to claim possessory interests during 2009 in leasehold property on Pensacola Beach with improvements that are being assessed for real property taxes.  There must be a tax due of greater than $0.

 

The following paperwork is required of new plaintiffs and must be received by November 20, 2009:

 

1.    Current and Complete Contact Information for Current Leaseholder

2.    Assignment of Lease or Sublease This document shows the transfer of the lease from the prior leaseholder to the current leaseholder and should be a part of the closing packet.

3.    Copy of the 2009 Ad Valorem Tax Bill – tax bills are mailed around Nov. 1st

4.    A $275 Check or Money Order – Made payable to Shell, Fleming, Davis & Menge Trust Account.

 

Item #2 – Assignment of lease is available through the SRIA, if you do not have it on file.  Lease documents are also available at the Clerk of Court’s web site www.clerk.co.escambia.fl.us under “Official Records”.  Item # 3 - Tax bills can be accessed at the Tax Collector’s web site http://escambiataxcollector.governmaxa.com

 

Payment by check or money order and all the required paperwork must be received from the new plaintiffs no later than November 20, 2009.  Payment and paperwork must be mailed to:
