October 2, 2009 Update

Today marks 17 months since motions for summary judgment in our case were heard before Judge Michael Jones. There has still not been a ruling issued in the case.

The last update noted that our attorneys filed a motion to consolidate the five pending cases (tax years 2004- 2008). This provided an opportunity to bring our case back to the attention of the judge. The judge granted the motion for consolidate meaning that if summary judgment is granted to either side, it will be applicable in all other years’ cases. Our attorneys have also provided the judge with case law updates related to our case.

Danny Kepner from Shell, Fleming, Davis & Menge will be speaking about the still pending tax litigation at the Annual Membership Meeting of the Pensacola Beach Advocates on Wednesday, October 21^st at 6 pm. The meeting will be held at the Pensacola Beach Community Church Fellowship Hall on Via de Luna at Avenida 18. This meeting is open to members of Pensacola Beach Advocates and prospective members (residents, leaseholders and those with a business interest on Pensacola Beach).
