October 31, 2008 Update

 

·        Filing of a 2008 Complaint

 

The 2008 tax roll was certified on October 15th, which means our attorneys have until December 15th to file a fifth law suit challenging the ad valorem taxes of leasehold improvements on Pensacola Beach.  As has been explained before, if we fail to file each consecutive year until the matter is finally resolved, the court would be required by statute to dismiss each of the prior cases (2004 – 2007).  The 2008 complaint and plaintiff list are being prepared.

 

Plaintiffs from past years, who are being assessed 2008 taxes on the improvements, will be named as parties to the 2008 complaint.  This is true if you had a $0 assessment in 2005, 2006, and/or 2007 and have repaired or rebuilt and are being assessed on your improvements.  As long as the name of the plaintiff remains the same, parties from prior complaints will matched and appear as plaintiffs in the 2008 complaint.

PLEASE NOTE:  Any plaintiff in the initial 2004 lawsuit with a $0 assessment for any subsequent tax year can not be named in the complaint filed for that tax year.  This does not affect participation in the 2004 case or the return to the plaintiff list when taxes are assessed again.

A mailing is being prepared for all plaintiffs.  Most of the condo association managers have assisted with updating mailing addresses.  If you have moved and not provided current contact information, please do so via e-mail.  Please send your name, current contact information and the address of your Pensacola Beach leasehold property(s) to pbts@att.net  as soon as possible.
